The legality of medical marijuana and CBD oils has come under the spotlight over the past few years – not just because of the entire movement to legalize marijuana, but also because of the health and lifestyle industry popularizing the use of marijuana derived products in their brand portfolio.
As products like CBD gummies, oils, aromatherapy, and topical creams become more widely suggested as alternative treatments, consumers want to know the specifics of the laws that allow (or disallow) them to purchase them.
Unfortunately, there is no definite and final answer to the question “Is CBD legal?”. The variables that decide the legal status of CBD oil are far too complex. However, that is not to say that there is no answer. So to give a short but hopeful answer: yes, CBD is legal under very specific conditions.
According to the United State Food and Drug Administration (FDA), while the authority fully understands the growing medical use of marijuana and marijuana derived products, the issue is with drugs and companies that are using it in a way that goes against the safety and health laws that the FDA closely enforces.
In 2018, a revised bill was passed – the Farm Bill – which lifted restrictions on hemp-derived products (including CBD oils). This was a modification to the old 2014 bill. As a result, buying any hemp-derived CBD product with a THC level below 0.3% is legal. But this also varies from state to state, since state laws differ from federal laws.
Some states only allow purchase of CBD with a prescription. Some states consider CBD oil to be completely illegal. There are 33 states that have passed different kinds of laws and legislation’s on the use of medical marijuana, and 16 others have allowed low-level THC CBD use even though marijuana is not allowed.
The biggest deciding factor would be the amount of THC your product contains and how your CBD oil was derived. This means doing the adequate research to ensure that you buy high quality CBD oil, from companies with some kind of certification to prove that no cross contamination has occurred with THC producing parts of the plant.
